The judge failed to comply with the law and maintain professional competence in the law in the judge’s handling of a criminal case and misinterpreting and misapplying Article 45.0215 of the Texas Code of Criminal procedure; failed to treat the defendant and the defendant’s attorney with patience, dignity and courtesy, engaged in impermissible ex parte communications with the defendant outside the presence of the defendant’s attorney, and engaged in an extra-judicial activity which case reasonable doubt on the judge’s capacity to act impartially as a judge with respect to certain defendants.
